These Terms of Use (the "Terms") govern your access to and use of the PlantHelper mobile application (the "App" or "Service"), owned and operated by EVRIUS s.r.o ("EVRIUS", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App. Your access and use of the Service constitutes your agreement to be bound by these Terms, which establishes a legally binding contractual relationship between you and the Company. For this reason, PLEASE READ THE TERMS CAREFULLY BEFORE USING THE SERVICE.

Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must obtain consent from your parent or legal guardian.

Scope of Services

PlantHelper provides the following functionalities:

• Plant Identification: Users can identify plants using AI-based image recognition via the device’s camera.
• Personalized Watering Schedule and Reminders: Customized watering recommendations are generated based on plant type, pot size, location (indoors/outdoors), and environmental factors. Smart notifications remind users to water their plants according to their personalized schedule.
• Plant Health Diagnosis: AI-driven analysis of plant images allows users to detect signs of overwatering, nutrient deficiencies, pest infestations, and other issues.
• My Garden: Users can curate and manage a personal plant collection with individual care profiles and maintenance history.
• Light Meter: Using the device’s camera, users can measure light intensity in a specific location to optimize plant placement.

Account Registration

In order to use certain features of the Service, you may need to register an account ("Account") and provide certain information about yourself as prompted by the registration form. If you register an Account, you represent and warrant to the Company that:

1. all required registration information you submit is truthful and accurate;
2. you will maintain the accuracy of such information; and
3. your use of the Service does not violate any applicable law or regulation or these Terms.

You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account.

You agree to immediately notify the Company of any unauthorized use, or suspected unauthorized use of your Account or any other breach of security.

Updates and Modifications

The Service may be modified, updated, interrupted or suspended at any time without notice to you or our liability. We retain the right to implement any changes to the Service (whether to free or paid features) at any time, with or without notice.

Support

The Company has no obligation to provide you with customer support of any kind. However, the Company may provide you with customer support from time to time, at the Company’s sole discretion.

Subscription Fees and Payment

The PlantHelper App is free to download. However, certain features of the Service are offered for a fee on a subscription basis or one-time payment basis (“Purchase”).

You can make a Purchase either:

• directly from us via our website, or
• through third-party platforms such as the Apple App Store or Google Play.

By completing a Purchase, you authorize us and the respective payment providers to charge the applicable fee to your chosen payment method.

Price Changes

We reserve the right to change pricing at any time, to the extent permitted by applicable law. Any such changes will be communicated to you in advance, either through the App, our website, or by email. If you do not agree to the new price, you may cancel your subscription before the change takes effect.

Subscription Renewals

If you subscribe to a recurring plan, it may automatically renew at the end of each billing cycle, unless clearly stated otherwise at the time of purchase. By subscribing, you agree to allow us, the App Store, Google Play, or our payment processor to charge you for each renewal period. Renewal terms (including duration and pricing) will match the original subscription, unless otherwise disclosed.

You are responsible for managing your subscription and ensuring it is canceled before renewal if you no longer wish to use the service. Cancellation procedures are subject to the terms of the platform where the purchase was made.

Trial Periods

We may offer trial periods for certain subscriptions. Trial details (length, features included) will be shown before activation. Unless you cancel before the trial ends, your subscription will automatically continue and you will be charged the applicable fee. We are not responsible for notifying you when the trial ends — this remains your responsibility.

 

We may modify or cancel trial offers at our sole discretion, without notice or liability. We also reserve the right to restrict repeated use of trials.

Access Expiry & Non-Payment

Your access to paid features will end when your subscription period ends, or when all services in a one-time purchase have been used. If payment fails or is not received, we may suspend or terminate access without further notice, though we will try to notify you beforehand if reasonable.

Refunds

Purchases made via App Store/Google Play are subject to the refund policies of the respective platform. We cannot issue refunds for these — please contact Apple or Google support directly.

Purchases made via our website or through independent payment processors are subject to our own refund policy. Unless required by law, all purchases are final and non-refundable. By completing any Purchase, you confirm and agree that the payment is non-refundable and non-exchangeable, except where otherwise stated by applicable law.

Limited License

During your use of the PlantHelper application (the “Service”), we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• access and use the Service,
• install one copy of the application on your personal mobile device.

This license is strictly for your personal, non-commercial use. Any commercial or institutional use — including by businesses, educational institutions, agricultural enterprises, or consultants — is strictly prohibited unless explicitly authorized by EVRIUS s.r.o in a separate written agreement. The PlantHelper app is licensed, not sold. All rights not expressly granted to you remain the exclusive property of EVRIUS s.r.o or its licensors.

You may not, under any circumstances:

• Copy, distribute, modify, or create derivative works based on any part of the Service or App;
• Sell, lease, rent, sublicense, export, or transfer the App or Service to any third party;
• Reverse engineer, decompile, disassemble, decode, or attempt to extract source code or algorithms from the App or Service;
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
• Use the Service to interfere with, disrupt, damage, or gain unauthorized access to networks, devices, or data;
• Use the Service in any manner that infringes upon the rights of others (including intellectual property rights or privacy rights), or violates any applicable laws or regulations.

Any unauthorized use constitutes a material breach of these Terms and will result in immediate termination of your license without notice. We also reserve the right to take legal action or seek compensation where applicable.

Proprietary Rights

All rights, title, and interest in and to the PlantHelper application, including the software, mobile app, website, all features and functionalities, content, AI models, source code, user interface, and any versions, updates, bug fixes, enhancements, patches, or modifications (collectively, the “Service”) are and shall remain the exclusive property of EVRIUS s.r.o or its authorized licensors.

This includes, without limitation, all associated intellectual property rights, such as:

• registered or unregistered copyrights,
• patents (pending or granted),
• trade secrets,
• trademarks and service marks,
• design rights, and
• other proprietary materials or technologies.

You acknowledge that no ownership rights are transferred to you by using the Service. This agreement grants you only a limited, revocable, non-transferable right to use the Service in accordance with these Terms.

The PlantHelper name, logo, and any related brand marks are trademarks of EVRIUS s.r.o. No license or right to use them is granted under these Terms, whether by implication, estoppel, or otherwise.

Indemnification

You agree to indemnify, defend, and hold harmless EVRIUS s.r.o, its affiliates, partners, licensors, employees, officers, directors, contractors, representatives, and service providers (collectively, the “Protected Parties”) from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• your use or misuse of the PlantHelper app or Service;
• any content you upload, submit, or transmit via the Service;
• any breach of these Terms;
• your violation of any applicable law or third-party rights;
• any unauthorized use or misuse of your account or password, whether or not authorized by you.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with such defense as reasonably requested.

Warranty Disclaimers

The PlantHelper application and all related services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. Your use of the Service is at your sole risk.

To the fullest extent permitted under applicable law, EVRIUS s.r.o, its licensors, affiliates, and service providers expressly disclaim all warranties, including but not limited to:

• implied warranties of merchantability,
• fitness for a particular purpose,
• non-infringement,
• accuracy or reliability, and
• any guarantee of uninterrupted or error-free performance.

We do not warrant or guarantee that:

• the App or Service will meet your expectations or specific use cases,
• it will operate continuously, securely, or without technical errors or defects,
• any bugs or issues will be corrected immediately.

We are not responsible for:

• device damage, data loss, or any other harm resulting from your access to or use of the Service;
• security breaches, unauthorized access, or interception of data or transmissions;
• viruses, trojans, or malware that may be transmitted via the App or its servers by third parties;
• interruptions in service due to network or technical issues beyond our control.

We do not endorse or assume liability for any third-party content, services, or products promoted or linked within the App, nor are we a party to any transaction between you and such providers.

AI-Based Recommendations and Plant Outcomes Disclaimer

The PlantHelper app provides suggestions, tips, and diagnostics based on artificial intelligence and image recognition technologies. These features are intended for general informational and hobbyist use only.

• While we strive to offer accurate and helpful insights, you acknowledge and agree that:
• The App does not replace professional or certified botanical, horticultural, or agricultural advice.
• The App does not account for all environmental, biological, or geographic variables, nor does it adapt in real-time to changing conditions affecting your plant.
• The AI models used in the App operate on statistical likelihoods and training data — not expert human validation.

As such, EVRIUS s.r.o. shall not be held liable for any consequences resulting from:

• plant death or damage,
• incorrect care routines based on our recommendations,
• use of the App in commercial or agricultural contexts (e.g. plant nurseries, farms, vertical gardens),
• financial losses, crop failures, or reputational harm suffered by individuals or businesses relying on the App.

You use any plant care instructions, watering schedules, health assessments, or placement suggestions entirely at your own discretion and risk. If you are unsure how to care for a particular plant or need professional evaluation, we strongly encourage you to consult a certified horticulturist, botanist, or plant expert. The Service is provided “as is”, and you bear full responsibility for all actions taken based on its content or output.

Termination

This Agreement becomes effective from the moment you first access the Services or install the Software and remains in effect until terminated by either you or us (the “Term”). You may terminate this Agreement at any time by completely uninstalling the Software. If you fail to comply with the terms of this Agreement or any other agreement you have with us, your license and this Agreement will automatically terminate. Upon termination, your license will expire, and you must stop all use of the Software and Services.

We reserve the right, at our sole discretion and without prior notice, to take any of the following actions at any time:

• Restrict, deactivate, suspend, or terminate your access to the Services, including deleting your account and all associated information and files;
• Refuse, move, or remove any content available through the Services;
• Implement additional general rules and limits regarding the use of the Services.

We may take these actions for any reason, including but not limited to: (a) your breach of this Agreement, (b) requests from law enforcement or government agencies, (c) your request, (d) discontinuation or significant modification of the Services (or any part thereof), and (e) unexpected technical or security issues. You agree that we will not be liable to you or any third party for taking any of these actions.
